By accessing Pectora at https://app.pectora.com, you are agreeing to be bound by these terms of use, all applicable laws and regulations, and agree that you are responsible for compliance with any applicable local laws. If you do not agree with any of these terms, you are prohibited from using or accessing this site. The materials contained in this website are protected by applicable copyright and trademark law.

Use License

1. Permission is granted to temporarily download one copy of the materials (information or software) on Pectora's website for personal, non-commercial transitory viewing only. This is the grant of a license, not a transfer of title, and under this license you may not:
   1. modify or copy the materials;
   2. use the materials for any commercial purpose, or for any public display (commercial or non-commercial);
   3. attempt to decompile or reverse engineer any software contained on Pectora's website;
   4. remove any copyright or other proprietary notations from the materials; or
   5. transfer the materials to another person or "mirror" the materials on any other server.

Limitations

In no event shall Pectora or its suppliers be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption) arising out of the use or inability to use the materials on Pectora's website, even if Pectora or a Pectora authorized representative has been notified orally or in writing of the possibility of such damage. However Pectora does not make any commitment to update the materials.

Electronic Signatures

Students enrolled in courses that require an electronic signature to be placed on documents are required to provide their electronic signature. Before the conclusion of any course requiring an electronic signature, the instructor will review all documentation that will have the electronic signature applied with the students in the class. If a student has questions or concerns, the student should speak directly with the course instructor.

Pectora has not reviewed all of the sites linked to its website and is not responsible for the contents of any such linked site. The inclusion of any link does not imply endorsement by Pectora of the site. Use of any such linked website is at the user's own risk.

Modifications

Pectora may revise these terms of use for its website at any time without notice. By using this website you are agreeing to be bound by the then current version of these terms of use.

Governing Law

These terms and conditions are governed by and construed in accordance with the laws of Florida and you irrevocably submit to the exclusive jurisdiction of the courts in that State or location.

Model Release

Authorization for Use of Image, Voice, and Likeness

By accessing or using Pectora, or by participating in any training, course, or activity offered through Pectora, or by Ellis International or any of its subsidiaries, you hereby grant a worldwide, royalty-free, irrevocable, perpetual, transferable, and unrestricted right and license to record, capture, create, obtain, use, reproduce, display, perform, distribute, transmit, publish, adapt, edit, modify, create derivative works from, and otherwise exploit your image, likeness, and sound of your voice (collectively, "Likeness"), as may be captured in photographs, audio recordings, video recordings, screen captures, or any other media, in connection with your use of the LMS, participation in in-person training, or your performance of your duties.

You acknowledge and agree that your Likeness may be used, in whole or in part, alone or in conjunction with other material, in any form or media now known or hereafter developed, for any lawful purpose, including but not limited to education, training, quality assurance, internal review, publication, promotion, illustration, advertising, marketing, trade, or archival purposes, without additional notice to you and without compensation or any other consideration.

To the fullest extent permitted by applicable law, you irrevocably assign, transfer, and convey to Pectora, Ellis International, and its subsidiaries all right, title, and interest that you may have or acquire in and to any recordings, photographs, or other materials incorporating your Likeness created or obtained by or on behalf of Pectora, Ellis International, or its subsidiaries including all copyrights and other intellectual property rights therein. You waive any right to inspect or approve any such materials or the manner in which they are used.

You understand and agree that you are not entitled to any compensation, royalties, or other payment in connection with the creation, or use of your Likeness as described herein, and that such use is not subject to any obligation of confidentiality except as otherwise required by applicable law or stated in Pectora's privacy policy.

To the maximum extent permitted by law, you release and discharge Pectora, Ellis International, andtheir parents, subsidiaries, affiliates, officers, directors, employees, contractors, agents, licensees, successors, and assigns from any and all claims, demands, causes of action, damages, liabilities, and expenses (including, without limitation, claims for invasion of privacy, violation of rights of publicity, defamation, or any similar claim) arising out of or in connection with the creation, use, reproduction, editing, display, publication, or distribution, of your Likeness as authorized herein.
